在台灣，移工與雇主的工作契約為三年，期滿後才可「自由轉換」。合約未滿期間，除非雇主同意，或因雇主死亡、歇業、不可歸責於移工的勞資爭議等合法事由，移工才能向勞動部申請轉換。
